(VAN) MONRE requested the People's Committee of Quang Ninh province to review the project's environmental impact assessment report in Ha Long Bay's buffer zone

MONRE has just issued an official dispatch requesting the People's Committee of Quang Ninh province to carefully review the content of the Environmental Impact Assessment Report (EIA) and the Decision approving the results of the appraisal of the EIA report of the 10B urban area project. This is to see whether or not they fully comply with the provisions of law on environmental protection, and consequently, take appropriate and timely handling measures.

According to the content of the official dispatch and information on the mass media, Do Gia Capital Co., Ltd. started construction of the 10B urban area project, Quang Hanh ward, Cam Pha City is at risk of adversely affecting the natural landscape, the impact on the water environment quality of Ha Long Bay is receiving public attention.

MONRE requested the People's Committee of Quang Ninh province to review the appraisal process and approve the appraisal results of the project's environmental impact assessment report (EIA) according to Decision No. 1614/QD-UBND dated June 15, 2023.

Carefully review the content of the EIA Report and decide whether the EIA report appraisal results fully comply with the provisions of the law on environmental protection or not. This is to take appropriate and timely measures; requesting to review the contents of the environmental impact assessment of the 10B Urban Area project.

It is necessary to pay attention to a number of issues including the project's compatibility with the Quang Ninh Provincial Planning for the period 2021 - 2023, with a vision to 2050 that was approved by the Prime Minister in Decision No. 80/QD-TTg dated February 11, 2023.

The appropriateness of identifying and determining project entities and activities that have the potential to have adverse impacts on the environment, especially impacts on the natural landscape, biodiversity preservation and marine environment quality in Ha Long Bay in the project implementation area.

The suitability and feasibility of the works and environmental protection measures ensure maximum minimization of negative impacts from project implementation on the natural landscape, mangrove ecosystem, biodiversity and coastal seawater quality in the project implementation area.

The Ministry of Natural Resources and Environment requested the Provincial People's Committee to direct the inspection and supervision of the company in implementing the contents and requirements on environmental protection according to Decision No. 1614/QD-UBND. In cases where violations of the law on environmental protection are discovered, they must be strictly handled in accordance with regulations.

The inspection process should pay attention to compliance with the construction process of project items, construction time (according to the area's tidal regime), implementation of technical solutions and environmental protection according to the company's commitment to the environmental impact assessment report approved by the appraisal results and relevant legal documents.

Require the company to strictly comply with legal regulations on environmental protection and relevant laws.

In case there is a basis to judge that the contents and requirements on environmental protection in Decision No. 1614/QD-UBND are not strict, complete and consistent with actual implementation, the company is required to research and supplement technical measures and solutions to protect the environment to minimize negative impacts from project implementation on the regional marine environment.

The results of implementing the above contents were requested by the Ministry of Natural Resources and Environment to be reported by the People's Committee of Quang Ninh province before November 15, 2023.

In addition, the Ministry also requested that the Provincial People's Committee in the process of attracting investment projects in the area, request the Committee to pay attention to directing the correct implementation of the Party and State's guidelines and legal policies; not sacrificing the environment for mere economic development; properly implement environmental protection goals for areas with environmentally sensitive factors that are vulnerable to the impacts of environmental pollution in general in the province, especially for the world natural heritage site of Ha Long Bay.

Along with that, ensuring that natural ecosystems in natural heritage must be given priority to preserve and restore their original state, ensuring that the core values of nature and biodiversity of natural heritage are preserved and protected, and ensuring other contents on environmental protection of natural heritage according to the provisions of Clause 7, Article 21 of Decree No. 08/2022/ND-CP dated January 10, 2022, of the Government detailing several articles of the Law on Environmental Protection.​
